Former Sleepy Eye Police Chief Sues Over Termination

Sleepy Eye's former Police Chief has filed a federal lawsuit against the city.David Seivert was fired back in October of 2007.City Leaders fired him for substance abuse.Now he's suing for discrimination... saying his substance abuse was a disability... and deserves protection under the Americans With Disabilities Act.News 12's Bryan Piatt has been following this story and joins us live in the newsroom.Dion, David Seivert lost his job after the Sleepy Eye City Council decided that he was 'unfit to perform the duties of police chief'.The council's decision came after several reports of Seivert involved in substance abuse while on and off duty.The Minnesota Court of Appeals upheld the council's decision.Today, Seveirt's attorney, Phil Valluame (Vill-yum), says Seveirt was chemically dependant and that, under the American Disabilities Act he was wrongfully discriminated against because of it.Phil Villaume says, "Mr. Seivert, formerly Chief Seivert was chemically dependent and the city knew that and they should have accommodated his disability."Villaume (Vill-Yum) also says the city of Sleepy Eye violated the Minnesota Peace Officers Bill of Rights by not conducting an independent investigation into Seveirt's alleged misconduct.Phil Villuame says, "The officer is entitled to make a statement. He's entitled to be represented by counsel, he's entitled to a hearing challenging the discipline. None of that was done in this case."The attorney representing the city of Sleepy Eye says they *did follow proper procedure and that it was confirmed by the Minnesota Court of Appeals.She says Seivert's alleged chemical dependency doesn't protect him from discipline because of misconduct on the job.Patricia Beety says, "There was no violation of the ADA laws. The discipline and discrimination laws don't immune Mr. Seivert's conduct whether he had a disability or not. I think there is very much a lack in the record that he actually was disabled."Seivert's attorney says they hope to have him reinstated as the Sleepy Eye Police Chief and provide him with reasonable compensation for losses after losing his job.Dion, back to you.
