Grand Jury Hears Evidence In Officer Involved Shooting

Back in July Kasota's Tyler Heilman was shot and killed by a plain-clothes LeSueur County Sheriff's Deputy.A grand jury convened today surrounding the case in LeSueur County.News 12's Erick Lind is in the newsroom to let us know why the case has gone to a grand jury.Nicole, I talked to Mankato attorney Mark Betters this afternoon, and he says there are two reasons a grand jury is used in Minnesota.First, if the charges would require a life sentence if convicted.The other is in this type of situation where law enforcement is involved, and there's a community that may be tempted to think there's a conflict of interest when law enforcement is accused of wrong doing.Betters says, "In a situation like that, rather than your typical DWI for instance, where a prosecutor would feel comfortable reviewing a few papers and deciding whether to press charges, the grand jury is used as a way to, in a way, take that decision away from the prosecutor."Betters says the prosecutor is even brought in from Anoka County to further remove doubts of a conflict of interest.The grand jury earns its name because it is made up of 16 to 23 people rather than a normal 12.However it only takes 12 jurors to believe the charges are appropriate for an indictment to be made.Betters says the primary difference with a grand jury is that they are not looking to prove somebody guilty beyond a reasonable doubt.They are only to show there is probable cause that a crime has been committed.Betters says, "It simply means charges are appropriate. It does not mean necessarily that a conviction will follow."Betters says unlike a trial, the defendant cannot be present for a grand jury and the presentation is kept confidential so the only way you know the outcome is whether or not an indictment comes in the future.Live in the newsroom, Erick Lind, News 12.
