A partial victory for James Nibbe's family in their civil lawsuit against Jennifer Nibbe.
The Nibbes are suing Jennifer for wrongful death in the killing of James Nibbe back in 2010.
On October 25th, the judge granted a partial summary judgment, ruling that the evidence overwhelmingly showed that Jennifer Nibbe was liable in James' death.
With the ruling, the focus of the trial will now shift to whether the plaintiffs can prove damages.
Also last week, the judge granted a motion allowing the plaintiffs to sue for punitive damages in addition to general damages.
Trial in the civil case was originally set for November 13th and 14th; a new trial date has not been set.
